Swimming pools in Maryland must adhere to state regulations regarding pool fence barriers. Maryland regulations state that a swimming pool must be enclosed by a barrier that is at least 5 feet above the ground and has a maximum vertical clearance from the bottom of the barrier of 4 inches. The fence also must not have any openings that will allow the passage of a sphere 4 inches in diameter. The barrier access gate should be located near the shallow end of a pool, and have a latch release located at least 54 inches from grade level that is lockable. The gate must open away from the pool or spa and be self-closing and self-latching.
